A wrongful death claim can be defined as a death that results from a wrongful act or from negligence, which can serve as the basis for a civil action for damages on behalf of the dead person's family or heirs. Wrongful death claims may result from automobile accident or traffic fatality or other accident resulting in fatality. No amount of money can ever replace a loved one, but when someone dies through the fault of another party, the surviving family members may be compensated for their financial losses. California law allows the decedent's estate to file a wrongful death action because the deceased family member is not available to bring a case against the person causing their death. An executor or administrator of the estate may be a spouse, child, parent or other relative representing the estate. California Civil Code of Procedure imposes strict time guidelines for filing such claims.
Some of the monetary damages that can be recovered as a result of the wrongful death claim can include medical expenses, loss of future income from the decedent and loss of consortium, which is the loss of support, love, affection and guidance.
Strict time guidelines are required by California Code of Civil Procedure for filing wrongful death actions. If you intend on filing a claim, you should do so immediately or if the statute of limitations expires, you may be forever barred from filing your claim and possibly receiving recovery.
